In-Kind Contributions

Definition of an In-Kind Contribution

An in-kind contribution is the provision of goods, equipment, materials, or services, without monetary payment, in support of the Kuwait Emergency Response Fund. It is subject to the same Basic Funding Rule: it is limited to what relates to the repair of damage to infrastructure, facilities, and assets resulting from the Iranian aggression against the State of Kuwait, and does not extend to development or modernization works.

Eligible Contributors

In-kind contributions are accepted from government entities, national institutions, the private sector, and public-benefit associations. As with financial contributions, they are not accepted from individuals.

1  |  Submitting the In-Kind Contribution Letter to the Fund

The contributing entity submits an official letter addressed to the Kuwait Fund for Development, setting out the following:

A description of the goods, equipment, materials, or services offered, together with their quantities or scope and specifications.
The estimated value of the contribution and the basis on which it was determined, with supporting documents such as invoices or quotations.
Whether the contribution is earmarked for a specific government entity or open to the affected government entities.
The method of delivery or implementation and the expected timeframe.
The details of the contributing entity's representative and the person responsible for follow-up.

Conditions for Accepting a Contribution

An in-kind contribution is not accepted if it is subject to any condition in favor of the contributing entity or any third party, and it may not give rise to any preference, advantage, or direct or indirect benefit to the contributing entity. The management and operation of contributed goods and equipment pass to the beneficiary entity upon handover, without prejudice to any maintenance, training, or technical support agreed with the contributing entity.

Project and Funding Approval

2  |  Review of the Contribution by the Fund

The Fund reviews the contribution letter and its attachments to verify that the contribution relates to the repair of damage resulting from the aggression, and that its details and estimated value are complete. The Fund requests any clarifications or documents needed before proceeding

3  |  Path for Contributions Earmarked for a Specific Entity

The Fund coordinates with the specified government entity to confirm its need for the contribution and its acceptance of it.
The beneficiary entity obtains the approval of its competent minister to receive the contribution, in accordance with the rules governing the acceptance of donations, gifts, and the like in government entities (Ministry of Finance Circular No. (1) of 2024).
The Fund notifies the contributing entity of the approval and of the delivery or implementation arrangements.
Where the specified entity does not require the contribution, the Fund may, with the contributing entity's consent, process it under the path for non-earmarked contributions.
Outcome of the Review

Selection of the Contracted Party

Definition of the Contracted Party

The party selected by the beneficiary entity, in accordance with its legal and contractual procedures, to carry out the works approved for funding by the Fund.

4  |  Path for Contributions Not Earmarked for a Specific Entity

Possible Selection Methods
The Fund submits the contribution letter and its details to the Council of Ministers to take the action it deems appropriate.
The Council of Ministers circulates the contribution to the relevant ministries and government entities to identify their needs.
Entities wishing to benefit submit their needs to the Kuwait Fund for Development for review and consideration of those deemed appropriate.
The Fund approves the allocation of the contribution to the appropriate entity or entities and coordinates with them and with the contributing entity on delivery or implementation arrangements.
Each beneficiary entity obtains the approval of its competent minister in accordance with the rules referred to in Step 3.
Controls to Observe When Contracting
The beneficiary entity bears responsibility for the soundness of the selection, award, and contracting procedures.
The scope of the contract is limited to the works approved for funding by the Fund.
The contract value, duration, and payment terms must be consistent with the approved funding.
The contracting documents must reflect the funding requirements and mechanism approved by the Fund.
The Fund does not bear the cost of development or modernization works or any unapproved costs.
The Fund must be notified of any material change in scope, value, or implementation period before any additional obligation is incurred.

The Selection Method Is the Beneficiary Entity's Responsibility

The Fund does not impose a specific contracting method; the beneficiary entity follows its own approved legal procedures, bearing in mind that the contracted works will be financed by the Fund.

Registration of the Contracted Party's Contract

5  |  Delivery, Implementation, and Monitoring

After completing the selection of the contracted party and concluding the contract, the beneficiary entity registers the contract with the Fund before submitting any disbursement request, so that its consistency with the approved funding scope and amount can be verified.

As a condition for preparing and concluding the disbursement agreement with the beneficiary entity following the award decision, the beneficiary entity must provide evidence that it has obtained the prior approvals of the State Audit Bureau, the Central Agency for Public Tenders, and the Fatwa and Legislation Department, each within its jurisdiction and in accordance with the applicable laws and regulations.

Documents Required for Contract Registration

Goods, equipment, and materials are delivered directly to the beneficiary entity, and services are performed directly for it, in coordination with the Fund.
Transport, installation, training, maintenance, and any other obligations are agreed between the contributing entity and the beneficiary entity and recorded in the handover record.
The beneficiary entity inspects the contribution, verifies its conformity with the approved specifications, and certifies receipt of the goods or completion of the services.
A handover record is drawn up and signed by the representatives of the contributing entity and the beneficiary entity, setting out the description, value, and condition of the contribution at handover, with a copy provided to the Fund.
Ownership of goods, equipment, and materials passes to the beneficiary entity upon receipt, and the entity registers them in accordance with its applicable systems.
The Fund records the contribution in its in-kind contributions register and monitors its implementation, in coordination with the beneficiary entity, through to completion.

What the Fund Does Not Cover

The Fund does not bear any costs associated with an in-kind contribution and does not store, operate, or maintain contributed goods or equipment. Responsibility for implementation and operation remains with the beneficiary entity.
Review of the Contract by the Fund
The Fund reviews the contract to verify its consistency with the approved scope of works, funding amount, duration, payment schedule, and any other conditions attached to the funding decision. Registration of the contract does not constitute approval of any works or amounts exceeding the approved funding.

Media Recognition

The Fund's management dedicates media coverage to the in-kind contribution, including handover, installation, or service-launch events, in coordination with the contributing entity and the beneficiary entity.
